GENERAL SALES CONDITIONS

1)    Subject
The contract hereby sets forth the General Sales Conditions between the company Plasmor, Zone St-Léonard Nord, 56 450 THEIX (France), SARL with capital of 64 790.83 Euros, RCS Vannes B331 996 660 00022 which accepts selling to a customer who accepts the product and the payment of this one.

2)    The product
The specifications indicated in our leaflet and our website as well as our prices are submitted to variations without notice.

3)    The trademark
The trademark owns to the company Plasmor . It as been testified and recorded in France under number : 1 700 886

4)    The price
The currency : all the prices are in Euros (EUR) and without VAT for export
The Incoterm : The prices indicated are under EXWorks Theix Plasmor Incoterm (from our factory Plasmor)

5)    Payment
The payment must be settled by 1/3 while ordering and by 2/3 while delivering

6)    Delivery
The transport of the goods is to be done according to the incoterm chosen by the buyer and the seller. The delivery time limit cannot be under the responsability of Plasmor which is free from any charges regarding a delay.

7)    Ownership
Plasmor remains owner of the goods which have been supplied until  complete payment of them.(payment of the goods and the transport from Plasmor to the customer ‘s home)

8)    Guarantee
Our kayaks and boats have a 2-year guarantee against manufacturing defect or design fault. In such case, Plasmor is able to send free to the customer parts and equipment needed to repair it for a duration of 1 year. However, port is due by the customer.
Plasmor is able to call for a independant maritime expert to check the boat before delivery, payable by the customer.

9)    Claims
In case of a claim, Plasmor is able to send free to the customer parts and equipment needed to repair it for a duration of 1 year since the date of buying. However, port is due by the customer.

10)     Dispute
All disputes arrising shall be resolved amicably between the parties. If such disputes cannot be settled in a amicably way, they shall be reffered to arbitration by the Vannes Chamber of Commerce as instrument within the frame of the European Economic Community.

11)    Jurisdiction
The french law is the law applicable in such contract and the court of Vannes is the only competent court.


12)    Force Majeure
Neither of the parties shall be liable vis-à-vis the other because of Force Majeure and more particularly because of war, riots, fire, explosion, flood, sabotage, and any other even beyond its control. In such event, the parties shall meet to determine the contract continuation, or to decide on early cancellation.
